Terms and conditions

1. General Provisions

  1. These Terms and Conditions set out the rules for using the profidesk.io educational platform, hereinafter referred to as the “Platform”, managed by Superlativa Sp. z o.o., with its registered office in Lublin, ul. Agatowa 17/37, 20-571 Lublin, NIP: 9452183819, KRS: 0000553701, hereinafter referred to as the “Administrator”.
  2. The platform is designed to provide interactive textbooks and multimedia exercises for teachers and pupils. Its main purpose is to support the educational process by providing modern teaching tools.
  3. Use of the platform is possible once the User has created an Account and accepted these Terms and Conditions.

2. Definitions

  1. Administrator – Superlativa Sp. z o.o., with its registered office in Lublin, responsible for managing and maintaining the platform, protecting personal data and ensuring that the platform’s operations comply with applicable legislation.
  2. User – a natural person who has registered on the platform and holds the status of a teacher or pupil.
  3. Account – a User’s individual profile created on the platform, enabling the use of its resources and functionalities.
  4. Content – all teaching materials, textbooks, exercises, articles, videos, graphics and other resources available on the platform.

3. Registration and user account

  1. Registration on the platform is required for both teachers and pupils. The registration process involves providing personal data, such as first name, surname, email address and other information necessary for the proper use of the platform.
  2. Once registered, teachers must be approved by the administrator. The verification of teachers is intended to confirm their identity and ensure that they are using the platform for educational purposes.
  3. Pupils may use the platform without further verification; however, their registration also requires the provision of basic personal data.
  4. The User is obliged to provide true and up-to-date information during registration and to update it regularly in the event of any changes.
  5. If the User is under 16 years of age, consent to the creation of their account – i.e. acceptance of these Terms and Conditions and the consents required during the account creation process – must be given by the User’s legal guardian.

4. Access and payment terms

  1. Free access to the platform is available exclusively to teachers and pupils* of state and non-state primary schools.

    *Pupils receive free access upon purchase of the printed version of the textbook – the activation code is located on the book’s cover. Holders of older editions of the textbook (without a QR code on the cover) may obtain free access by contacting hello@profidesk.io and attaching proof of purchase of the book.

  2. Language schools and their teachers may purchase access to the platform via the online shop at sklep.wydawnictwodraco.pl.
  3. Access to the platform is valid for 15 months from the date the account is activated, regardless of whether access was granted free of charge or purchased. One purchase is permitted per email address.
  4. Teachers interested in the teaching resource pack may contact Customer Services at hello@profidesk.io for further details.

5. Use of the Platform

  1. Users may use the available Content in accordance with its educational purpose. Every User has the right to access the teaching materials made available by the Administrator and to use the tools and features offered by the platform.
  2. The User undertakes to use the platform in a manner consistent with the law, these Terms and Conditions, and the principles of social coexistence. In particular, the User is obliged not to infringe the rights of others and not to upload to the system any content that is illegal, offensive or infringes the rights of third parties.
  3. The following is prohibited:
    • Sharing Content with third parties without the Administrator’s consent, which includes copying, distributing and other forms of disseminating materials.
    • Using the platform for activities that are unlawful or infringe the rights of others, including sending spam, or content that is vulgar, pornographic, discriminatory or promotes violence.
    • Uploading to the platform any content that is illegal, offensive or infringes the rights of third parties, including, in particular, copyright-protected material without the appropriate licence.
  4. Licence to use the Content:
    The User acquires a non-exclusive licence to use the Content available on the platform solely for educational purposes. The licence entitles the User to view and use the Content within the platform on any electronic device. The User must not copy, modify, distribute or otherwise use the Content beyond the permitted scope without the Administrator’s written consent. A breach of the licence terms may result in the immediate deletion of the User’s Account.

6. Users’ rights and obligations

  1. The User has the right to:
    • Access the Content made available on the platform and use it in accordance with its intended purpose.
    • Use the platform’s features, such as viewing materials, participating in interactive lessons, asking questions and communicating with other Users.
    • Receive technical support regarding the use of the platform, which includes assistance with resolving technical issues and providing information on the platform’s features.
  2. The User is obliged to:
    • Comply with the provisions of these Terms and Conditions and all applicable laws.
    • Ensure the security of their Account, including by not disclosing login details to third parties and by changing passwords regularly.
    • Immediately notify the Administrator of any breaches of Account security or unauthorised access.
  3. Account closure:
    The User may close their Account at any time by first logging in and using the ‘Delete Account’ option available in their profile settings. Closing an Account is free of charge and results in the immediate removal of access to the platform. For Users who have purchased paid access to the platform, deleting the Account results in the loss of all paid privileges without the possibility of a refund. Once the Account has been deleted, the Administrator will delete the User’s personal data, with the exception of data which the Administrator is obliged to retain in accordance with applicable law.

7. Rights and obligations of the Administrator

  1. The Administrator undertakes to:
    • Ensure the continuous operation of the platform and to take all necessary measures to ensure its availability and security.
    • Protect Users’ personal data in accordance with applicable law, including the implementation of appropriate technical and organisational measures to ensure its security.
    • Informing Users of any changes to the Terms and Conditions, as well as of planned technical downtime and updates.
  2. The Administrator is entitled to:
    • Temporarily restrict access to the platform in order to carry out maintenance work, updates or other activities aimed at improving the functionality or security of the platform.
    • Delete a User’s Account in the event of a breach of these Terms and Conditions, in particular in the case of unlawful activities which may cause harm to other Users or the Administrator.
    • Monitor Users’ activity on the platform to ensure compliance with these Terms and Conditions and the law.

8. Liability

  1. The Administrator shall not be liable for:
    • Damage arising from the improper use of the platform by Users, including breaches of the Terms and Conditions and applicable laws.
    • Disruptions to the platform’s operation caused by factors beyond the Administrator’s control, such as technical failures, interruptions to internet service provision, force majeure or cyber-attacks.

9. Complaints

  1. Users may submit complaints regarding the operation of the platform to the following email address: hello@profidesk.io. The complaint should include a detailed description of the problem and the User’s contact details.
  2. Complaints will be dealt with within 14 working days of the date of submission. The Administrator undertakes to inform the User of the outcome of the complaint and of the actions taken to resolve the reported problem.

10. Final provisions

  1. The Administrator reserves the right to amend these Terms and Conditions. Users will be notified of any amendments via the platform. Amendments to the Terms and Conditions shall come into force on the date specified by the Administrator, provided that this is not less than 7 days from the date of their publication.
  2. In matters not covered by these Terms and Conditions, the applicable provisions of Polish law shall apply. Any disputes arising from the use of the platform shall be settled by the competent ordinary courts.
  3. These Terms and Conditions shall come into force on the date of their publication on the platform.
